1. Service Description Beans 'n' Bun operates as a restaurant based in Mermaid Beach, Queensland, Australia, offering delicious burgers, loaded fries, hot dogs, wings, desserts, and other food items for online ordering, pickup, or delivery (where applicable). Our operating hours are:
- Sunday to Thursday: 5:00 PM to 9:30 PM AEST
- Friday and Saturday: 5:00 PM to 10:00 PM AEST
2. Online Ordering & Payment
- Order Placement: Orders can be placed through our online platform on https://beansandbun.com.au/.
- Order Acceptance: All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order at our discretion.
- Pricing: All prices are listed in Australian Dollars (AUD) and are inclusive of GST where applicable. Prices are subject to change without notice.
- Payment: Payment for all orders must be made in full at the time of placing the order through the payment methods offered on the Service.
3. Delivery & Pickup
- Pickup: If you select pickup, your order will be prepared for collection at our Mermaid Beach location (2309 Gold Coast Hwy, Mermaid Beach QLD 4218) during our operating hours. Estimated pickup times are provided but are not guaranteed.
- Delivery (if applicable): If delivery is offered, delivery times are estimates and may vary due to factors beyond our control (e.g., traffic, weather). We are not liable for delays in delivery. Please ensure correct delivery address and contact information are provided.
- Risk: Risk of loss or damage to food items passes to you upon pickup or upon delivery to your specified address.
4. Cancellations
- Orders can generally be cancelled only if preparation has not yet begun. To request a cancellation, please contact us immediately by phone at 0404 646 782 during our operating hours.
- Cancellations are at our sole discretion.
5. Refunds & Returns
- Our Refund & Return Policy applies to all orders. Please refer to our separate https://beansandbun.com.au/policies/refund-policy for full details.
- As we sell perishable food items, refunds or replacements are primarily offered in cases of quality issues, incorrect orders, or missing items, as outlined in our Refund Policy.
6. Accuracy of Information & Allergens
- While we strive for accuracy in our menu descriptions and pricing, errors may occur.
- Allergen Information: We prepare food in a kitchen where allergens such as nuts, gluten, dairy, and others are present. While we take precautions, we cannot guarantee that any item is completely free of allergens. Limitation of Liability In no event shall Beans 'n' Bun, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
10. Governing Law These Terms shall be governed and construed in accordance with the laws of Queensland, Australia, without regard to its conflict of law provisions.
11. Changes to Terms We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will try to provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
